‘Horrific results’

The province’s Workplace Safety and Insurance Board is hurting the workers it’s supposed to help, says the president of a local support group.

Members of the Ontario Federation of Labour and the Thunder Bay and District Injured Workers Support Group were occupying MPP Michael Gravelle’s office Wednesday morning to protest what group president Gerald Landry calls the "horrific results" of people trying to deal with WSIB. He said the members, around five of them just after 10 a.m., would stay there all day or until they could speak with Gravelle.

The Thunder Bay MPP, who is also Ontario’s Minister of Northern Development, Mines and Forestry, was out of town Wednesday morning. His office was one of six constituency offices to be occupied across the province.

"There’s some real mean-spiritedness going on. It’s just catastrophic," Landry said. "They are causing trauma themselves to injured workers."

Injured workers are being cut off from benefits, which forces them to apply for Ontario Works.

Others are forced back to work even though they qualify for the federal government’s disability fund. Some are bullied by employers when they do return to work or are harassed by private investigators and WSIB return-to-work specialists. It’s all part of the board’s attempts to cut costs, Landry said.

“We see far, far too many people that are neglected," Landry said. "They try to keep people in the dark as to the policies and programs they do have."

The WSIB is supposed to help injured workers maintain the quality of life they had before being injured.

But Landry said there are far too many people coming into his office these days who just want to give up on life because of the challenges they are facing.
"People are just distraught," Landry said.

According to the OFL, benefits have decreased by 20 per cent since 1996 when inflation is factored in.

But Gravelle said the Liberal government has raised benefits, sometimes as much as 7.5 per cent in 18 months.

"That by no means brought them back to a level that was acceptable to them but it was one of the opportunities we had to try and bridge that gap between what their benefits were and what they should be," Gravelle said Wednesday afternoon on the phone from Toronto.

He had the chance to speak with the occupiers in his office on speaker phone Wednesday morning.

Gravelle said he had the chance to listen to their concerns and tell them that he was advocating for injured workers.

"There’s no question that there’s still a great deal of work to be done but this is something from the moment I was first elected in 1995 I’ve been working hard to represent the interests of injured workers and I will continue to do that," Gravelle said.

He said he's been working hard cince 1995," thats 16 yr's. This is how it work's with WSIB now. If you get hurt at work and wsib deem's you to not work at your job that you have been doing for the last 20 plus yr's," so they tell you at the age of 55 to go be a cashier," that's if at the age of 55 someone will hire you with no experance," then drop your benifit's to $10 some times less. I know someone this has happined to and has lost everything encluding the dog. One word of advise," dont get hurt at work wsib is not there for you.

Sorry but WSIB does not care about injured workers. I know too many horror stories of family and friends who were hurt on the job and WSIB screwed them hardcore. My uncle fought with them for 7 years when he injured his back at work, while doing everything properly and to code. Yet WSIB kept refusing his claim saying that he missed a form or he filled it our wrong, or that they lost his transcripts and had to do everything all over again.

WSIB is as corrupt as the government it works for. It is high time that they started working for they started working for the people, and not worry about how much more profit they can make.

As the previous comment points out, these problems with the services we pay for, as tax payers, have been escalating for many years now. We pay into EI, but then try to collect it. They badger you so much, you are tempted not to bother. WSIB won't pay without grief or inform workers of their rights and programs available. Also, how many people in Ontario can't get a family physician? The provincial government is failing the people of this province badly, and I think the solution is now to hire a lawyer and sue.

We are paying A LOT for these services, so if people are being mistreated, or if the services government agencies are supposed to provide are being denied, it's time the people of Ontario started standing up for themselves and unions or groups of citizens should start class action lawsuits.

Since 1996 benefits have decreased by 20%. Can they tell me how much benefits have decreased since 2004.

Cherry picking time lines as unions, or injured workers and welfare recepients do is typical. Tell us what these guys have done. Gravelle said 7.5% in 18 months. Sounds like a great amount of increase but is that after nothing for 36 months or on top of other increases. Who knows cause the story don't say. So one says things are lousy, one says things are good. Who is telling the truth.

The college staff is set to walk because management is not serious about negotiations. Management will say that they are trying hard to get a deal. Who is telling us the truth or is the truth somewhere in the middle.

Its is indeed a scary world.
Think about it, there is NO WAY to insure your current income 100% if you get hurt on or off the job.
Unless you have some type of disability insurance. And most likely it will almost be impossible to collect that insurance!
I am a unionized worker in health care. If i caught something or was injured on the job and could not work you know what I would get after 6 months?
Long term disability: LTB that is indeed if i could prove I was disabled.
LTB pays peanuts. We would not be able to afford our mortgage.

As a person who is on WSIB let me tell you the tactics and the underhandedness of the ajudicators is pathetic. I have been off for a few years and have had a few surgeries. I am hoping to return to my job in time when I am healed. My ajudicator keeps calling me and saying "ya know, it's been 4 months since your surgery" and we "really need to push this along" and "you should be healed by now" ....I have had several complications with my surgeries that my specialist didn't even forsee. I don't even know if I CAN return to my old job that I have been at for over 20 years because I don't know if I am capable of doing that type of work. So then what?? retrain me?? I would happily retrain if I had a job to come out of school to. But given my age and history with my injury, who will hire me? I am not going to be able to go on disability and I will not go on Ontario Works. SO...I am faced with the prospect of working at a low paying job and watching my co-workers happily cash their decent paycheck. I am mad as hell ..and Michael Gravelle can go to &*^% ...oops I can't say that....SIXTEEN years and he thinks the increase was a great accomplishment..It gave me a 1.78 raise on my WSIB cheque!! All I can say is DON'T get hurt at work..It is NOT a vacation. I miss my old life and would give anything to get up and go to work and have my paycheque back. Oh and very very true, WSIB witholds inforrmation on what they can offer to it's injured workers. Do your homework, they have alot more things than they claim. It's a business that is all about screwing the employee and saving the governement as much money as it can. Am I bitter....Oh ya......I am more disgusted then anything... Shame on Michael Gravelle for even thinking he has done anything to help us. Get off your butt and try harder, and not take 16 years to do it!

This is so true!! It is sickening how politicians give these empty soundbites that address absolutely nothing, but it is even more sicking how people sit back and accept it. Often I've noticed they don't even address the question asked...completely circumvent it.

Gravelle is no different than any of the rest of them. It's called politics for a reason, and people need to start understanding what that has come to mean: Social relations involving authority or power. Politics is about relationships that cultivate power and allocate resources where the people with power want them to go. It has very little to do with the good of the common person, and that is why politician's answers are so vague.

What's he going to say? Sorry you dumb schmucks, but you people keep paying to support a system of relationships that ensure you have the least possible share of control and resources, so of course you are going to get screwed at every turn. That's the truth and that's the answer to the question, but he's not going to come out with that!

Does wsib not top up a persons pre injury rate of pay to 80% if he/she are is back into the work force in a position that pays less?

Are workers held accountable when they have an accident and they are fully at fault and have not followed proper safe work guidelines?

Are payments from wsib taxable?

Should people who get hurt be intitled to stay home and not have to continue paying into the very system that they are relying on?

I reacently watched a great movie. "Soul Surfer" maybe some of you have heard about it...

Its about a young girl who lost her arm while surfing, a shark attack.... She never fully recovered learned to cope and deal with her new life...

Bad things happen and some people truly need help and insurance.. Others (most) feel sorry for them self and want a free ride.

Suck it up cope adapt to the new reality and carry on..

Could some one please reply to my questions at the top?

I can't answer your questions, Fed up. I have fortunately never had to apply for WSIB, but I have been very disappointed with my experiences trying to access other government services, so I think the point is that this problem is pretty much universal within the Ontario government.

About the girl who lost her arm; yes she may have recovered and resumed pretty much normal activity, but she didn't do that the day after the shark attacked her. How many months, years did it take for her to be fully recovered and to complete all the physio and occupational therapy needed for her to get rehabilitated? This you fail to mention.

WSIB is supposed to serve just that purpose. It is supposed to provide "INSURANCE" that covers peoples' incomes while they recover. If this takes 3 weeks, 3 days or 3 years, it should not matter, as long as the person is receiving treatment and working toward recovery. I think any competent, well-trained, experienced social worker can discern between the individuals who are sincerely working toward full recovery and return to work and the slackers who are trying to milk the system. Unfortunately, the tendency in our society is to reduce EVERYONE to the lowest common denominator. We're all guilty till proven innocent, and everyone gets treated like dirt, even the honest folks. It's all messed up.

I was injured at work more than 3 yrs ago. I did not heal in the "normal time frame" not because I was milking the system but because no Dr could determine the extent of my injury until I got an MRI which I asked the wsib "specialist" if he could order me one. I was told no that it was not nessasary in my case because what the ct scan showed looked like an old hockey injury to him. I grew up here but never played hockey a day in my life. (was too poor) This so-called professioal slipped me a piece of paper with a phone number on it and said I can tell you really want to get better so go see this physio therapist. He said I would be better in 10 weeks.(even though it was six months since I fell) I swear to god the dr and physio thearapist had a discusion in front of my face that and I quote stated "So what are we gonna call this one" I asked how they could diagnose me with something if they didn't actually know what was wrong with me. They became short with me and I was told I had to fit into one of wsib's pre determined boxes.
For eight months I could hardly walk from my kitchen to my couch without falling, let alone make love to my wife or care for my children. I went from shopping for my second home to contemplating suicide on my 35th birthday because I was in so much pain. I was offered oxycotine and percocette but refused because I did not want to add an addiction to my problems. I asked for whatever they could give me that was not narcotic. I went through a phyc evaluation and eventually had to go to a walk in clinic to get an mri done. I waited over a yr to see a specialist that does not work for wsib and finally I was given a cortozone shot in my spinal cord. For anyone to think that having a workplace injury is a ticket for a free ride in life obviously knows nothing about having to deal with wsib on top of living in pain to the point you would rather die.
I asked my dr if I could return to work after my needle because I felt great and he just chuckled and said no it is just a mask. He went on to say I needed to treat my back as though it was a heart attack and that I should always be on guard.
My most recent rift with wsib came when my ajuticater said I needed to come to realise they are the bread winner in my family now and I needed to treat them as such. I explained that I took a great deal of offence to that statement and that she needed to come to the realisation that she is merly a facilitator of my benifits that I am entitled to because I was injured at work. I have done my best to be an active member in my return to work. I went back to college and maintain honour roll status. I have worked since I was 12 and I am entitled to what I get.

Nor do their imaginary CPP deductions, which are never forwarded to the Canada Pension Plan. Wsib PILLAGE's the SOCIAL SAFETY NET, by not paying or providing Loss of Earning or paying for treatments & medications. You do not collect Ontario Works till you LIQUIDATE all your ASSETS. Summer camp, RRSP's, savings etc. Is this fair, because you were injured at work. And i cant forget that over 30% of Ontario workers are not protected by Wsib. Get hurt working for a Schedule 2 employer who does not pay premiums on payroll, and enjoy the abuse. Add the 30% of workers not covered, "Wsib is CRYING POVERTY". Maybe it is time they collected premiums for 100% of the workforce. In 1914 injured workers gave up the RIGHT to SUE employers. So how can you think a worker should be held accountable if his error caused the accident. Do you have No-fault Auto Insurance ? As for the young surfer who lost a arm, will she swim in the ocean again ? PTSD is a reality for some workers. My first work accident was electrocution, after arguing with the boss that it was unsafe, you know the guy that signs your checks. I gave in , and got shocked about 30 minutes later. I wanted to become an Electrician, do you really think i could after that, i still suffered trauma and fears 20 years later. A later compensible head on colission, which my Union did not know was, after Wsib became involved and asked about pre-existing injuries, their Investigativate Dept. stated there were no X-rays at the hospital. My, my what stategists. Oh, i got layed off 2 days after the x-rays were taken after the previous accident. Do you know how many "First Layoff's" i got by complaining about "Unsafe Work Condition's" I worked with 2 cranes where the booms broke off and fell to the ground narrowingly missing workers, another tipped over into a lake. Was it the workers fault ? Hope you never injure yourself in multiple areas, neck, uper & lower back, knee's, shoulder's etc. I know of many unfortunate individuals who suffer multiple injuries,their pain 24 hours per day is nothing to wish for. Wsib is not a "Lottery Ticket" as one Adjudicator stated to a injured worker. If anyone wants to swap the loss of quality of life, missed experiences with family, daily coping challenges, please step up to the plate. Countless share how they cant even roll or move in their beds without waking up from the pain, if they sleep at all. Ah yes and the pain and sleep impaired can fully participate in the workforce, while numbed by narcotics. ESRTW was a line used by Wsib. It meant Early & Safe Return to Work. Now they call their team members RTW, Return To Work Specialists. Or WTS, Work Transition Specialists, which if you cant return to your Pre-injury job,they will work with the Employer to accomadate you. if they cant you can be DEEMED/DREAMED to have an imaginary job where you will be deducted minumum pay for your scheduled weekly work hours. THey will pay for retraining at College or (University ?)once you graduate, you are deemed to be employed in your new career and are cut off LOE whether you have a job or not. You must now compete with a younger, healthier workforce. Reality is 60% of IW are un-employed and living in poverty. I call myself working trash, because Wsib, that we think is there to help us, all to often abuse us. Mol, or Ministry of Labor will resist enforcing Sect. 50 Employer Retaliation.
Life is but a dream till we get hurt at work.
