THUNDER BAY – Kimberly Fox has pleaded guilty to assault causing bodily harm in the January 2016 death of her sister.
According to court records, Charlotte Hudson was found dead of ligature strangulation, but there was no evidence that could establish who was responsible for her death.
The pathologist in the case noted signs of blunt-force injuries to Hudson’s head, torso and extremities.
Court was told that Fox’s sister-in-law, Juliet McKay, was with the two women on the night of Jan. 12, 2016 and witnesses a physical altercation between Hudson and Fox. She testified she witnessed Fox kick Hudson repeatedly in the face while Hudson was on the floor.
McKay and Fox then left for a night on the town, with stops at several local bars.
McKay returned to Hudson’s residence after 3 a.m., while Fox spent the night at her parents’ Walkover street home.
Fox was arrested the following afternoon.
Forensic DNA evidence confirmed the victim’s blood was on the accused’s foot and shoes.
Fox, who has been in jail since the incident occurred, was sentenced to 18 months behind bars, but the time was deemed served, having received the equivalent of 1.5 days for every day she was in jail.
Fox previously was convicted in 2015 of aggravated assault in the death of her then boyfriend.
A condition of her sentence means Fox will have to submit her DNA to a police databank and she faces a weapons prohibition for 10 years.
