THUNDER BAY - One of the three men charged in the 2019 murder of 40-year-old Lee Chiodo has pleaded guilty to the lesser charge of accessory after the fact to murder.
Marshall Hardy-Fox appeared virtually in a Thunder Bay Courtroom before Justice Bonnie Warkentin on Wednesday where he entered a guilty plea on the charges of kidnapping and accessory after the fact to murder.
Hardy-Fox was first charged with first-degree murder and kidnapping along with co-accused David Hui and Musab Saboon.
Chiodo’s body was found by a passerby in the Mission Marsh area on Feb. 24, 2019.
Hui, of Thunder Bay, was arrested in the Academy Drive area on March 2, while Hardy-Fox turned himself into police on March 3.
Saboon, who is from Kitchener, turned himself into Waterloo Police on March 5 and transported back to Thunder Bay after a Canada-wide warrant was issued for his arrest.
A 10-day trial for Saboon and Hui is scheduled to begin on Dec. 6, 2021 before a judge alone on the charges of kidnapping and first-degree murder.
Saboon remains in custody while Hui and Hardy-Fox have been previously released on bail.
No facts were read into the record on Wednesday and the charge of first-degree murder has not yet been withdrawn.
A pre-sentence report and a Gladue report have been ordered for Hardy-Fox. The matter has been adjourned to Aug. 30 for assignment court.
