Toronto teen charged with murder in motel homicide case to remain in custody

The teenager from Toronto was charged with second-degree murder in connection to 29-year-old Paul Winnifred Vivier's death.

THUNDER BAY - A 16-year-old boy charged with second-degree murder will remain in custody following a brief court appearance on Tuesday.

The teen who is originally from Toronto cannot be named due to provisions in the Youth Criminal Justice Act. 

He also faces a charge of possession of fentanyl for the purpose of trafficking, proceeds of property exceeding $5,000, and obstructing a police officer.

The teenager made an appearance by video before a justice of the peace and was remanded in custody with a future court date of July 2 at the request of his counsel Gilbert Labine.

The accused was charged in connection to 29-year-old Paul Vivier’s death.

Police were dispatched to the Midtown Inn on May 30 at 10:20 p.m. after responding to reports of a person in distress.

The victim was transported to the hospital where he was pronounced dead.

Thunder Bay Police Service have also arrested Denis Terry Bernard, 36, with second-degree murder in connection to Vivier’s death. A third suspect, Seandi Clarke-Noel, 19, has also been identified and charged with second-degree murder.

A court-ordered publication ban is in place which prevents the publication of details discussed at the accused’s court appearance. 

The teen will appear in court next month as his counsel continues to work on a bail plan.
