THUNDER BAY - A man convicted of aggravated assault in an incident that left a 63-year-old man with serious injuries will spend the next two years behind bars.
Tyson Stanley Spence, 32, was sentenced in a Thunder Bay courtroom on Monday, Oct. 23 to six years in jail, but will serve a reduced term after inclusion of credit for time spent in custody.
Justice Danial Newton handed down concurrent sentences of two years less a day for one count of break and entering, one count of aggravated assault, as well as a 90-day concurrent sentence for one count of failing to comply with a probation order and one count of resisting arrest.
Spence also received a 10-year weapons ban and is required to submit a DNA sample.
Spence was arrested in January, 2015 after attempting to break into a John Street Road residence where he assaulted the 63-year-old homeowner.
The incident took place on Jan. 3 just before 1 p.m. when a man was seen near the property by the homeowner, who worked at a business nearby. He went to investigate and was attacked by Spence.
Two plainclothes police officers in the area were alerted to the situation by staff of the business, and on arrival at the home discovered the resident being assaulted.
Spence was arrested after struggling with officers.
The victim was taken to hospital for treatment of his injuries.
